ARTES fine rentals \u2013 Rental conditions for stringed instruments
<\/strong><\/span><\/h6>

\u00a0<\/h3>

1. Scope<\/b><\/h3>
  1. These General Terms and Conditions (GTC) apply to all rental agreements between ARTES fine rentals (hereinafter referred to as \"Lessor\") and the respective tenant (hereinafter referred to as \"Tenant\") for the rental of stringed instruments.<\/li>
  2. Any differing terms and conditions of the tenant will not be recognized unless the landlord expressly agrees to them in writing.<\/span><\/li><\/ol>

    2. Conclusion of the lease agreement<\/b><\/h3>

    1. The rental agreement comes into effect upon acceptance of the rental request by the landlord.<\/span><\/p><\/li>

    2. Acceptance requires written confirmation from the landlord, including details of the instrument, the rental period and the rental costs.<\/span><\/p><\/li><\/ol>

      3. Rental property<\/b><\/h3>
      1. The subject of the rental agreement is the stringed instrument specified in the contract.<\/span><\/li>
      2. The instrument will be handed over to the renter in <\/span>playable condition<\/b>.<\/span><\/li>
      3. The exact condition of the instrument is documented in the handover protocol.<\/span><\/li><\/ol>

        4. Rental period and termination<\/b><\/h3>

        1. The minimum rental period is three months, unless otherwise agreed.<\/p><\/li>

        2. The lease term is automatically extended by one month unless terminated by either party with 30 days' notice to the end of the month.<\/p><\/li>

        3. Termination must be in writing (email or registered letter).<\/span><\/p><\/li><\/ol>

          5. Rent and Payment<\/b><\/h3>

          1. The rent is stipulated in the lease agreement and is payable monthly in advance.<\/p><\/li>

          2. Payment is made by bank transfer, credit card or another agreed payment method.<\/span><\/p><\/li>

          3. If the tenant defaults on payment, the landlord is entitled to demand default interest and to withhold the rent payment.<\/span><\/p><\/li><\/ol>

            6. Deposit<\/b><\/h3>

            1. The landlord can demand a security deposit.<\/p><\/li>

            2. The amount of the security deposit is determined by the rental agreement and is usually based on the insured value of the instrument.<\/span><\/p><\/li>

            3. The security deposit serves to protect against damages and outstanding claims.<\/span><\/p><\/li>

            4. The deposit will be refunded after the instrument has been returned and all claims have been settled.<\/span><\/p><\/li><\/ol>

              7. Obligation to use<\/b><\/h3>

              1. The tenant agrees to use the instrument carefully and exclusively for his own purposes.<\/span><\/p><\/li>

              2. Subletting, further letting or otherwise transferring the property to third parties is not permitted.<\/span><\/p><\/li><\/ol>

                8. Care, maintenance and repairs<\/b><\/h3>

                1. The tenant is obliged to treat the instrument with care.<\/span><\/p><\/li>

                2. Minor maintenance work (tuning pegs, strings, minor adjustments) is carried out by the landlord or a commissioned violin maker.<\/span><\/p><\/li>

                3. Major repairs may only be carried out after consultation with and written consent from the landlord.<\/span><\/p><\/li><\/ol>

                  9. Insurance and Liability<\/b><\/h3>

                  1. The rental instrument is insured against theft, loss and damage during the rental period.<\/span><\/p><\/li>

                  2. The insured value is based on a current valuation.<\/span><\/p><\/li>

                  3. The tenant is liable for damages exceeding normal wear and tear or resulting from improper use, up to the amount of the agreed security deposit.<\/span><\/p><\/li><\/ol>

                    10. Return<\/b><\/h3>

                    1. At the end of the rental period, the instrument must be returned on the agreed date in the same condition as when it was handed over, apart from normal signs of wear and tear.<\/p><\/li>

                    2. The instrument must be returned complete (including accessories).<\/span><\/p><\/li>

                    3. If the tenant fails to return the property, the landlord can demand compensation.<\/span><\/p><\/li><\/ol>

                      11. Data protection<\/b><\/h3>

                      1. The landlord collects and stores personal data for the purpose of executing the rental agreement.<\/span><\/p><\/li>

                      2. The privacy policy on the website applies.<\/p><\/li><\/ol>

                        12. Final Provisions<\/b><\/h3>

                        1. Amendments and additions to the lease agreement must be in writing.<\/span>
                          <\/span><\/p><\/li>

                        2. Should individual provisions of these terms and conditions be invalid, the remainder of the contract shall remain in effect.<\/span>
                          <\/span><\/p><\/li>

                        3. Swiss law applies. The place of jurisdiction is \u2013 to the extent permitted \u2013 Winterthur, Switzerland.<\/p><\/li><\/ol>
